TERMS OF USE

PREAMBLE
These Terms of Use, hereinafter the “Terms of Use” or “TOU”, govern access to the PIENUD website and its use by any visitor or user.
They are separate from the General Terms and Conditions of Sale, which govern purchases of products made on the website.
Use of the website implies compliance with these Terms of Use.
ARTICLE 1 – WEBSITE PUBLISHER
The PIENUD website is published and operated by ALF, a simplified joint-stock company with share capital of EUR 5,000, whose registered office is located at 25 rue de Ponthieu, 75008 Paris, France, registered with the Paris Trade and Companies Register under number 109 506 246 R.C.S. Paris.

ARTICLE 2 – PURPOSE OF THE WEBSITE
The purpose of the website is to present the PIENUD universe, products and services and to enable users to browse products, create an account when this functionality is available, add products to the cart, place orders and contact PIENUD.
Purchases made on the website are subject to PIENUD’s General Terms and Conditions of Sale.
ARTICLE 3 – ACCESS TO THE WEBSITE
Access to the website is generally free of charge, excluding connection, equipment or telecommunications costs borne by the user.
PIENUD endeavours to ensure the accessibility of the website but does not guarantee permanent or uninterrupted availability.
PIENUD may suspend, limit or temporarily interrupt all or part of the website, in particular for maintenance, updates, security, technical incidents, service changes or force majeure.
ARTICLE 4 – SHOPIFY PLATFORM
The PIENUD store is operated using the Shopify platform.
Certain technical features, in particular the cart, customer account, checkout, payments, Shop or Shop Pay services when enabled, may be provided in whole or in part through Shopify technologies and services.
Use of certain Shopify-specific services may also be subject to Shopify’s applicable terms when a direct relationship is created between the user and Shopify.
ARTICLE 5 – CUSTOMER ACCOUNT
When customer account creation is offered, the user must provide accurate, complete and up-to-date information.
The user is responsible for the confidentiality of their login credentials and for operations carried out from their account, except in the case of fraudulent use beyond their control.
They must inform PIENUD without delay if they notice unauthorised use of their account or a compromise of their credentials.
PIENUD may request reasonable verification before modifying sensitive information or granting access to certain data.
ARTICLE 6 – PROHIBITED CONDUCT
It is prohibited to use the website for unlawful, fraudulent, abusive purposes or in a manner that infringes the rights of PIENUD or third parties.
The following are prohibited in particular: any attempt to gain unauthorised access to systems or accounts, introduction of viruses or malicious code, mass or automated extraction of data without authorisation, abusive scraping, circumvention of security measures, use of bots intended to disrupt the operation of the website, payment fraud, identity theft, and any use likely to impair the availability, integrity or security of the website.
It is also prohibited to publish, transmit or communicate to PIENUD content that is manifestly unlawful, insulting, threatening, fraudulent, defamatory or infringing the rights of third parties.
ARTICLE 7 – INFORMATION AND CONTENT ON THE WEBSITE
PIENUD endeavours to provide accurate and up-to-date information. Material errors, omissions or differences in presentation may nevertheless occur.
Information relating to products, prices, availability, delivery and warranties is set out in product pages and the General Terms and Conditions of Sale.
Photographs and visuals are presented with the greatest care but may show slight differences in appearance, in particular due to screens, shooting conditions or the textile nature of the products.
ARTICLE 8 – INTELLECTUAL PROPERTY
The PIENUD website and all its elements, in particular the name, trademarks, logos, texts, photographs, videos, graphic creations, illustrations, drawings, models, structure, databases and content, are protected by applicable intellectual property rights.
Any reproduction, representation, adaptation, translation, extraction, reuse or exploitation, in whole or in part, without prior authorisation from the rights holder is prohibited, except where provided for by law.
Access to the website grants only a personal, non-exclusive right of consultation for lawful use.
ARTICLE 9 – REVIEWS, COMMENTS AND USER CONTENT
When the website allows a user to publish a review, comment, photograph or any other content, they remain responsible for the content they submit.
The user warrants that they have the necessary rights to the published content and undertakes not to publish unlawful, misleading, defamatory, infringing, privacy-violating content or content that infringes the rights of third parties.
PIENUD may remove or refuse manifestly unlawful content, without this creating a general obligation to monitor.
When the user voluntarily submits a photograph or content for publication on the website or PIENUD’s social channels, any commercial or public use by PIENUD will, where necessary, be subject to appropriate authorisation.
ARTICLE 10 – HYPERLINKS
The website may contain links to third-party websites or services. PIENUD does not control these services and is not responsible for their content, availability or practices.
The presence of a link does not mean that PIENUD approves, recommends or maintains a particular relationship with the website concerned.
ARTICLE 11 – SECURITY
The user must take reasonable measures to protect their equipment, credentials and data.
PIENUD implements appropriate security measures and benefits from security mechanisms offered by Shopify and its service providers, without being able to guarantee the absolute absence of IT incidents.
Any security anomaly observed may be reported to contact@pienud.com.
ARTICLE 12 – SUSPENSION OR DELETION OF AN ACCOUNT
PIENUD may suspend or delete a customer account when this is necessary to prevent fraud, ensure website security, comply with a legal obligation or end use manifestly contrary to these Terms of Use.
Where the situation allows, the user may be informed of the measure taken and its reason.
Suspension or deletion of an account does not deprive the Customer of their rights relating to orders already placed, legal warranties or the exercise of their rights regarding personal data.
ARTICLE 13 – PERSONAL DATA AND COOKIES
Personal data processing carried out when using the website is described in PIENUD’s Privacy and Personal Data Protection Policy.
The use of cookies and other trackers is also described in that policy and managed through the consent tool available on the website.

ARTICLE 14 – LIABILITY
PIENUD is liable within the limits provided by law for the services it provides directly.
PIENUD cannot however be held liable for damage resulting from unlawful or non-compliant use of the website by the user, fault of the user, failure of their equipment or connection, a third-party service independent of PIENUD or a force majeure event.
No clause in these Terms of Use may have the effect of excluding or limiting a mandatory right recognised to the consumer.
ARTICLE 15 – REPORTING CONTENT OR A PROBLEM
Any user may report to PIENUD content they consider unlawful, an infringement of intellectual property rights, a security anomaly or a malfunction at contact@pienud.com.
The report must include sufficient information to enable PIENUD to identify the content or problem and examine the request.
ARTICLE 16 – AMENDMENT OF THE TERMS OF USE
PIENUD may amend these Terms of Use at any time to reflect changes to the website, features, regulations or technical practices.
The applicable version is the one published on the website on the date of consultation.
An amendment to the Terms of Use does not affect the rights and obligations arising from an order already placed, which remain governed by the General Terms and Conditions of Sale applicable to that order.
ARTICLE 17 – APPLICABLE LAW
These Terms of Use are governed by French law.
Where the user qualifies as a consumer and resides in another country, the choice of French law does not deprive them of the mandatory protective provisions to which they are entitled under applicable regulations.
